This website is operated under the business name Nord Parfums, based in Minnesota, United States. Throughout the website, the terms “Nord Parfums,” “we,” “us,” and “our” refer to Nord Parfums. Nord Parfums offers this website, including all information, features, products, and services available through it (collectively, the “Service”), to you conditioned upon your acceptance of these Terms of Service (“Terms”) and all policies referenced in them.

By visiting our website, creating an account, or purchasing from us, you agree to these Terms. These Terms apply to all users of the Service, including browsers, customers, and anyone who submits content. If you do not agree to these Terms, you may not access or use the Service.

We may update these Terms by posting a revised version on this page. Your continued use of the Service after an update becomes effective constitutes acceptance of the revised Terms, to the extent permitted by law.

Our online store is hosted by Shopify Inc., which provides the ecommerce platform that allows us to offer products and services to you.

Section 1 — Eligibility and Online Store Terms

By using the Service, you represent that you are at least the age of majority in your state of residence, or that you are the age of majority and have consented to a minor dependent’s use of the Service under your supervision.

You may not use our products or Service for any illegal or unauthorized purpose or violate any applicable law, including intellectual-property, consumer-protection, transportation, or hazardous-materials laws. You must not transmit malware, viruses, or destructive code. A violation of these Terms may result in suspension or termination of your access to the Service.

Section 2 — General Conditions

We reserve the right to refuse or cancel Service or orders where permitted by law, including when we reasonably suspect fraud, payment abuse, unauthorized resale, pricing errors, prohibited shipping destinations, carrier restrictions, or violations of these Terms.

Your content, other than payment-card information, may be transferred across networks and adapted to technical requirements. Payment-card information is encrypted during transmission in accordance with the payment provider’s practices.

You may not reproduce, duplicate, copy, sell, resell, scrape, or exploit any portion of the Service without our prior written permission, except as allowed by law.

Section 3 — Products, Authenticity, and Independent Retailer Status

Nord Parfums is an independent fragrance retailer and reseller. Unless expressly stated otherwise, we are not affiliated with, sponsored by, endorsed by, or an authorized dealer of the designers, fragrance houses, manufacturers, or trademark owners whose products appear on our website. Brand names, trademarks, bottle designs, and product images belong to their respective owners and are used only to identify the products offered.

Products represented as genuine are offered as authentic. Product packaging, labels, cellophane, batch codes, bottle design, color, and formulation may vary because of manufacturer changes, reformulations, production batches, regional packaging, or storage and aging. These normal variations do not by themselves indicate that a product is defective or inauthentic.

We may sell retail-boxed bottles, testers, unboxed bottles, samples, or independently prepared decants. The applicable product type and condition will be identified on the product page. Testers or unboxed products may differ in packaging or presentation and may not include a retail box or decorative cap unless stated.

Any decant or sample identified as prepared by Nord Parfums is independently transferred from an original fragrance bottle into a smaller container. It is not sealed, packaged, sponsored, or approved by the original fragrance manufacturer. Decant fill levels may have minor visual variation because of bottle shape, headspace, and filling tolerances, but the stated volume is the intended net quantity at the time of filling.

Section 4 — Product Information, Availability, and Prices

We make reasonable efforts to present product descriptions, images, sizes, colors, concentrations, conditions, and prices accurately. Screen settings, lighting, manufacturer changes, or other factors may cause differences in appearance. Product images may be illustrative; the written product description controls if an image and description conflict.

Inventory is limited and not guaranteed until payment is accepted and the order is confirmed. Products may sell out, be restocked, or be discontinued without notice. We may impose quantity limits per customer, household, payment method, billing address, or shipping address.

Prices, promotions, discount codes, and product availability may change without notice. Unless otherwise stated, discounts cannot be combined. We may correct pricing, inventory, description, promotion, shipping, or other errors and may cancel an affected order even after submission. If we cancel a paid order, we will refund the amount charged for the canceled item or order.

Section 5 — Orders, Billing, and Account Information

Your submission of an order is an offer to purchase. An automated order confirmation acknowledges receipt but does not guarantee acceptance. We accept an order when we confirm shipment or otherwise expressly approve it. We may verify identity, billing information, shipping information, or payment authorization before accepting an order.

You agree to provide accurate, current, and complete account, billing, payment, email, telephone, and shipping information. You are responsible for reviewing the order, delivery address, unit number, and contact details before submitting payment. You must promptly update information needed to complete the transaction or contact you.

You represent that you are authorized to use the payment method submitted. Applicable taxes, shipping charges, and other disclosed charges will be added to the order total.

Section 6 — Shipping and Delivery

Nord Parfums currently ships only to eligible destinations within the United States that are offered at checkout. Shipping availability depends on the product, destination, ZIP code, carrier acceptance, applicable law, and hazardous-materials or dangerous-goods restrictions. The appearance of a state or region in a general website selector does not guarantee that every product can be shipped there.

Alcohol-based fragrances may be classified as flammable liquids or dangerous goods. We may select or change the carrier, service level, route, packaging, labeling, or delivery method needed to ship an order lawfully and safely. Expedited or air service may be unavailable. We do not ship to a destination, post-office box, military address, forwarding service, or air-only location when the product or shipment is prohibited or the carrier will not accept it.

Processing and delivery estimates are not guarantees. Delays may occur because of carrier operations, weather, security screening, dangerous-goods handling, peak volume, address issues, or events outside our reasonable control. Separate items in one order may ship separately.

You are responsible for providing a secure and deliverable address and for monitoring tracking information. If an address is incorrect, incomplete, refused, inaccessible, or unclaimed, we may charge or deduct actual reshipping, return, storage, or carrier costs from any refund where permitted by law and our Refund Policy.

If tracking shows a package as delivered but you cannot locate it, or if an order arrives damaged or leaking, contact us promptly at support@nordparfums.com and follow the claim instructions in our Shipping Policy. Do not use a leaking or visibly damaged fragrance product.

Section 7 — Cancellations, Returns, and Refunds

Order cancellations, changes, returns, exchanges, damaged-product claims, missing-item claims, and refunds are governed by our Refund Policy and Shipping Policy, which are incorporated into these Terms by reference.

Because orders may enter processing quickly and fragrance shipments require special preparation, we cannot guarantee that an order can be changed or canceled after submission. Contact us as soon as possible at support@nordparfums.com. If an order has already been processed or shipped, the applicable return rules will apply.

Nothing in these Terms or our policies limits a consumer right that cannot lawfully be waived.

Section 8 — Product Use and Safety

Fragrances are for external use only unless the manufacturer expressly states otherwise. Follow all warnings and instructions on the original product or packaging. Keep fragrance away from heat, sparks, open flame, eyes, children, and pets. Do not ingest fragrance.

Ingredients and formulations may change. If you have allergies, sensitivities, a medical condition, or concerns about a product, review the manufacturer’s current ingredient information and consult an appropriate professional before use. Discontinue use if irritation or an adverse reaction occurs. Information on our website is general product information and is not medical advice.

Section 9 — Optional Tools and Third-Party Services

We may provide access to third-party tools, payment processors, applications, or services that we do not control. They are provided on an “as is” and “as available” basis without endorsement or warranties from Nord Parfums. Your use of third-party services is subject to the third party’s terms and privacy practices.

We may add, modify, or discontinue website features, products, or services at any time, subject to applicable law.

Section 10 — Third-Party Links

The Service may contain links to websites or services not affiliated with Nord Parfums. We are not responsible for examining or guaranteeing third-party content, products, availability, accuracy, security, or practices. Your dealings with third parties are at your own risk and are governed by their terms and policies.

Section 11 — Reviews, Feedback, and Other Submissions

If you submit a review, photo, comment, suggestion, or other content (“Submission”), you grant Nord Parfums a worldwide, nonexclusive, royalty-free, transferable, sublicensable license to use, reproduce, edit, publish, translate, distribute, and display that Submission in connection with our business and marketing, subject to applicable law and our Privacy Policy.

You represent that you own or have permission to submit the content and that it is accurate and does not violate another person’s intellectual-property, privacy, publicity, or other rights. Submissions must not be unlawful, misleading, defamatory, abusive, obscene, or contain malware. We may monitor, refuse, or remove Submissions where permitted by law, but we have no obligation to do so.

Section 12 — Personal Information

Our collection, use, and disclosure of personal information is governed by our Privacy Policy. Shopify and other service providers may process personal information as described in their own notices and in our Privacy Policy.

Section 13 — Errors, Inaccuracies, and Omissions

Information on the Service may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, prices, promotions, availability, shipping charges, transit estimates, or other matters. We may correct or update information and cancel affected orders at any time, including after an order is submitted. If we cancel a paid order, we will refund the amount charged for the canceled portion.

Section 14 — Prohibited Uses

You may not use the Service or its content:

for an unlawful, fraudulent, abusive, or deceptive purpose;
to violate applicable federal, state, or local law;
to infringe intellectual-property, privacy, publicity, or other rights;
to harass, threaten, discriminate against, defame, or harm another person;
to submit false information or impersonate another person;
to upload or transmit malicious code;
to collect or track personal information without lawful authorization;
to spam, phish, scrape, crawl, or use automated means that burden or interfere with the Service;
to bypass security, purchase limits, fraud controls, geographic restrictions, or access controls; or
to purchase, ship, or resell products in violation of law or carrier restrictions.

We may suspend or terminate access for a prohibited use and may cooperate with lawful investigations.

Section 15 — Intellectual Property

The Nord Parfums name, logo, website design, original photographs, graphics, text, and other content created or owned by us are protected by applicable intellectual-property laws. Except for personal, noncommercial use of the Service, no license is granted without our prior written permission.

Third-party trademarks and product materials remain the property of their respective owners. Their appearance on the Service does not imply affiliation or endorsement.

Section 16 — Disclaimer of Warranties

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” We do not warrant that access will be uninterrupted, timely, secure, or error-free, or that every website error will be corrected.

Except for an express promise stated in these Terms, a product page, or a separate written policy, and subject to non-waivable consumer rights, Nord Parfums disclaims all warranties and conditions, express or implied, including merchantability, merchantable quality, fitness for a particular purpose, durability, title, and noninfringement.

Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.

Section 17 — Limitation of Liability

To the fullest extent permitted by law, Nord Parfums and its owners, employees, contractors, agents, affiliates, suppliers, and service providers will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages, including lost profits, lost revenue, lost data, or replacement costs, arising from or related to the Service, these Terms, or a product purchased through the Service, even if advised that such damages were possible.

To the fullest extent permitted by law, Nord Parfums’ total liability for a claim arising from or related to an order will not exceed the amount you paid to Nord Parfums for the product or order giving rise to the claim.

These limitations do not apply to liability that cannot lawfully be excluded or limited, including any rights or remedies that applicable consumer law makes non-waivable.

Section 18 — Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Nord Parfums and its owners, employees, contractors, agents, affiliates, suppliers, and service providers from third-party claims, liabilities, losses, and reasonable costs arising from your material breach of these Terms, unlawful misuse of the Service, or violation of another person’s rights.

Section 19 — Severability

If any provision of these Terms is held unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted or severed, and the remaining provisions will remain in effect.

Section 20 — Termination

These Terms remain effective until terminated by you or Nord Parfums. You may terminate them by ceasing to use the Service. We may suspend or terminate your access if we reasonably believe you violated these Terms, subject to applicable law. Provisions that by their nature should survive termination will survive, including payment obligations, intellectual-property provisions, disclaimers, liability limits, indemnification, and governing-law provisions.

Section 21 — Waiver and Entire Agreement

Our failure to enforce a provision is not a waiver of that provision. These Terms, together with policies and rules posted on the Service, form the entire agreement between you and Nord Parfums regarding the Service and supersede prior communications on the same subject. Any ambiguity will not automatically be interpreted against the drafting party.

Section 22 — Governing Law

These Terms and any separate agreement through which Nord Parfums provides the Service are governed by the laws of the State of Minnesota and applicable federal law, without regard to conflict-of-law principles.

Any dispute will be brought in a court of competent jurisdiction located in Minnesota, except where applicable consumer law gives you the right to bring a claim elsewhere or otherwise prohibits this requirement.

Section 23 — Changes to These Terms

We may update these Terms by posting the revised version and changing the effective date. Where required by law, we will provide additional notice. The version posted when an order is accepted will generally govern that order unless applicable law requires otherwise.
